This maintenance doesn't understand the realization of modules complementary or of news versions of the software that will make the object of license rights separated. Propositions of stakes at new version days will make themselves in the setting of the general offers to the set of customers. The contract of aid maintenance is concluded for a length of one renewable year by tacit renewal. AID FAX OR INTERNETAlliance soft commits to provide an aid by fax or Email for all relative questions to the use of software defined in this present estimate. The aid, on consignment of questions by fax or Email of the customer, is assured during days and hours of opening normal of Soft alliance. Either: * Of the Monday to the Friday of 10 hours at 12 hours and 14 hours at 17 o'clock. This aid doesn't substitute himself for users for the formation. In the same way, the new staff formation maybe insured in the setting of this aid. Soft alliance commits to make diligence to provide the asked information. TELEPHONIC AIDSoft alliance commits to provide a telephonic aid for all relative questions to the use of software defined in this present estimate. The telephonic aid, on call of the customer, is assured during days and hours of normal openings of Soft alliance. TELEMAINTENANCEThe customer commits to equip itself/themselves of a system permitting a télémaintenance, either: * A software Laplink Professionnel for Windows * (price indicative 230,00 €S H.T.TVA 19,6%) * A direct telephonic access on a station of the network equipped of a modem SOFTWARE: GUARANTEED AND LICENSEGUARANTEEDThe use of software is guaranteed 12 months following their receipt. The guarantee is about all defect of working. For it Alliance Soft intervenes free as soon as possible in order to assure the necessary corrections. Are not covered by the guarantee interventions required by the false manœuvreses, mistakes, oblivions of users or all other problem non bound to software. In this case Alliance Soft will invoice the time passed on the basis of 100 € HTS (VAT in addition 19,6%) out expenses appendices (transportation, lodgings,…). This hourly rate is révisable every year according to the evolution of the SYNTEC indication. The customer commits to designate for it an unique interlocutor for all interventions that only will be allowed to give instructions. No indemnity will be granted for deprivation of enjoyment, the material and software being used under the only direction and responsibility of the customer, we cannot be held for persons responsible of the direct consequences of his/her/its exploitation or his/her/its immobilization. RIGHT OF PROPERTIES THE SOFTWARE under license belongs to Alliance Soft. The customer and his/her/its users won't make anything that either prejudicial or contrary to rights of Soft alliance. The reproduction of software and documents partners is only allowed for reasons of security and while mentioning at every time rights of owners on supports. The customer declares to have taken knowledge of specifications of the software, and considers them as adapted to his/her/its needs. All modification of software achieved without previous agreement of Soft alliance is forbidden. All rights of property and right of relative authors to the SOFTWARE (including, in a non restrictive manner, those pertaining to all picture, mini - application, photograph, animation, music, all factor video or resonant and all text integrated to the SOFTWARE), to the printed documentation that comes with him and are detained by Alliance - Soft to all copies of the SOFTWARE. The SOFTWARE is protected by the regimentation and the international treaties concerning rights of authors. CONDITIONS OF USE Use is submitted to the assignment of a freeing code bound to the serial number. A new code will be necessary all 1000 openings of the program. He/it will be delivered gracefully subject to verification of license and reserve of right. Relative limitations to the engineering backwards, to the thimble compilation and the désassemblage. : You are not allowed to reconstitute the logic of the SOFTWARE PRODUCT, to the thimble to compile or to disassemble it, except insofar as these operations would be permitted expressly by the applicable regimentation in spite of the present limitation. DISSOCIATION OF COMPONENTS The SOFTWARE is conceded under license as unique product. He/it is not permitted to dissociate his/her/its components to use them on more of a computer. RENTING You are not allowed to lend or to give in renting the SOFTWARE. TRANSFER OF SOFTWARE You are not allowed to transfer the set of your rights foreseen by the user's license that to permanent title, solely in the setting of the sale or the transfer of the computer, provided that you didn't preserve any copy of it, that you transferred the totality of the SOFTWARE (including all his/her/its components, supports and the documentation printed, all updating,) All transfer must include all previous versions of the SOFTWARE. TERMINATION Without prejudice of all other rights, Alliance - Soft will be able to terminate your user's license if you don't respect terms of it. In this case you should destroy all copies of the SOFTWARE and all his/her/its components. STAKE AT DAY If the SOFTWARE is an updating of another product, that it was about an Alliance - Soft product or a product of another supplier, you cannot use or transfer the SOFTWARE that in association with this product put up to date, unless you destroyed the product put up to date. If the SOFTWARE PRODUCT is an updating of an Alliance - Soft product, you can use this product henceforth put up to date. If the SOFTWARE is an updating of a component of a set of software that you got under license like an unique product, the SOFTWARE can be used and transferred solely like part of this set of software and cannot be dissociated to be used on more of a computer. FORMATION The staff charged of the stake in œuvre and the exploitation of programs must present a level of expertise sufficient. Their formation is therefore indispensable. the formation maybe dispensed on site or in accepted center. METHODS AND EDUCATIONAL MEANS The formative approaches every part of the practicum according to a precise educational method: * General demonstration on screen * Theoretical exercises * Detailed explanations * Questions / Answers * Convenient exercises The formation is dispensed by a face-to-face educational in computerized formation room. There is 1 to 2 training maxima by station data processing. A support of course summarizing the chapter is distributed before the beginning of every practicum. |
